How the New Jersey Divorce Process Works

A divorce begins when one spouse files a Complaint for Divorce. That document establishes both parties’ addresses, the grounds for divorce, and an asset and debt cut-off date. New Jersey is a no-fault state, so the filing spouse isn’t required to allege wrongdoing. Most cases proceed on the no-fault ground of irreconcilable differences, though fault grounds such as adultery or addiction can also be stated. Once filed, the non-filing spouse has 35 days to respond.

From there, the path depends on how much the parties agree on. When both spouses reach agreement on asset division, child custody, support, and alimony, the case can proceed as uncontested and be finalized without a trial. When disagreements remain, the Monmouth County Family Division reviews the case, and unresolved issues proceed toward trial.
