The Divorce Process in New Jersey

For many, the divorce process begins when an attorney files a complaint on an individual’s behalf. The complaint formally establishes three things:

  • The addresses of the two parties involved, ensuring that they are both in the correct state and county
  • The reason for divorce, be it irreconcilable differences, adultery, physical or mental cruelty, or other grounds for divorce that New Jersey law outlines
  • A cut-off date that marks debts and assets the parties acquired prior to the cut-off date as shared; these same assets and debts will then be considered for equitable distribution in the divorce

An individual who wants a divorce does not need to serve the complaint directly to their spouse. Instead, filing a complaint through an attorney allows for the attorney to serve the complaint in place of their client.

Once the complaint has been filed and served, the individual’s spouse has 35 days to respond. For those who do not wish to file a complaint, the attorneys of the parties involved can work together to reach an agreement that doesn’t require the parties to go to court.

What Does Divorce Look Like if You Have Children?

If you are getting a divorce and have children, you will likely need to navigate the process of determining child custody and child support. While custodial arrangements and how much child support each parent pays are issues that can be decided outside of court, frequently parents settle issues in court. Attorney Megan S. Murray has proven her ability to carefully and effectively handle child custody and child support cases.

How Do Courts Decide if I Pay or Receive Alimony?

New Jersey law states that if a person is financially dependent on their spouse before a divorce, they might be entitled to alimony. Like the other aspects of divorce cases, determining whether a person should pay or receive alimony and for how long they might do so is a complex process. Opinions often differ between parties in alimony cases and emotions frequently run high. After all, for both those who pay and receive alimony it can be life-altering. Receiving knowledgeable and caring legal guidance is imperative in alimony cases so you get a resolution that is fair.

How New Jersey Courts Handle the Division of Assets Through Divorce

New Jersey laws aims to distribute assets “equitably” through a divorce. This does not mean that assets are distributed exactly 50/50. Instead, a court will seek to determine a fair way to distribute assets based on factors such as the couple’s standard of living before divorce, the income and earning capacity of the individuals involved in the divorce, and the value of the individuals’ assets among other additional factors. Because dividing assets is notoriously difficult, it is important to put your trust in a law office like ours, who fights to protect what is yours and seeks to get what is fair for you and your family.

High Net-Worth Divorce Cases Demand Lawyers with Our Experience

High net-worth divorces are like other divorces with one important difference: high net-worth divorces often require courts to examine and consider assets that are a greater in number and varied in type. If you are attempting to navigate a high net-worth divorce, it is a best-practice to settle matters of child support, alimony, and the division of assets in court, and it is even better to have a lawyer who focuses on high net-worth cases by your side. Megan S. Murray has a track-record of helping individuals in high net-worth divorces protect their interests and resolve their cases equitably.
